The Funday Genie's website (the "Site"), including its content, applications and services (the "Services"), offered by YooGuide Ltd. (collectively the "Company", "We" or "Us"), is an application (web and mobile) for planning a free day in your preferred city (“funday”). Our scheduling and best route algorithm, creates a personalized day-itinerary of things to do, including events, attractions, restaurants, shopping, and more, based on your preferences. The site provides you a wizard with 3 main steps: Choosing what the preferred theme is, when the funday is, and choosing from our picks of what’s going on today, after which the application presents your planned tour in the city – your funday.
This Privacy Policy (the "Policy") forms part of the Terms of Use available at the Site, and applies to YooGuide's information collection and use policies with respect to the Site and Services. By using this Site and/or any of the Services you consent to the terms of this Policy and to the practices described in this Policy. If you do not agree to this Policy in whole, please do not use the Site and the Services.
1. Information We Collect
When you visit the Site you may provide us with personally identifiable information ("PII") you knowingly choose to disclose that is collected on an individual basis. PII means any information that may be used to identify you, including your Email Address, your personal password, your Facebook and/or Twitter profile details (such as name, email, gender, birthday, current city, hometown and profile picture URL), and basic site information (URL, Channel, Impression Traffic etc., and any funday information you may save when logged in to your account).
In addition, if you choose to correspond with the Site through Email or electronic communication of any kind, we may retain the content of your Email messages together with your Email address and our responses.
Furthermore, similarly to other commercial web sites, we collect non-personally identifiable information ("Non-PII") about how our users use and respond to the Site and/or the Services.
Such collected Non-PII may include the user's IP address, domain, browser type, system and language, referring website addresses, date/time of visits, page view data and search keywords.
Non-PII is collected using such standard web technologies as the following:
• "Cookies" are data files, which often include an anonymous unique identifier, sent to your browser from a website, as pieces of information that are placed on your computer hard drive to enable you to more easily communicate and interact with the Site and/or the Services. We may use cookies to save certain Non-PII about you, in order to facilitate and enhance future activities with the Site and/or Services. We do not use cookies to retrieve information from a computer that is unrelated to the Site and/or Services.
We may use an outside advertising company to display advertisements on the Site and Services. These ads may contain Cookies. The advertisement company may collect Cookies received with outside ad banners.
We use both Session Cookies and Persistent Cookies. A Persistent Cookie remains on your hard drive after you close your browser. Persistent Cookies may be used by your browser on subsequent visits to the site. Persistent Cookies can be removed by following your web browser’s directions. A Session Cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all Cookies or to indicate when a Cookie is being sent. However, some features of the Site and/or Services may not function properly if the ability to accept Cookies is disabled.
• “Log files” track actions occurring on the Site and collect data including your IP address, browser type, Internet service provider, referring/exit pages, platform type, date/time stamp, click data and types of advertisements viewed.
• "Web beacons" or "Pixels" are electronic files used to track your navigation of a website or collection of sites, the completion of transactions, submittal of applications and browsing behavior. When you use the Site and/or Services, we may employ clear gifs (a.k.a. Web Beacons) which are used to track the online usage patterns of our users anonymously. No PII from your personal Funday Genie account is collected using these clear gifs. In addition, we may also use clear gifs in HTML-based Emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make the Funday Genie better for our users.
• "IP Addresses" - An Internet Protocol address is a number that is automatically assigned to a computer when using the Internet. Web servers can automatically identify individual computers by their IP address. We may collect IP addresses to:
o Facilitate system administration;
o Diagnose system problems;
o Report aggregate User information; and
o Avoid hacking attacks on the Site and/or Services server.
We do not link IP addresses to any PII, even if such information is voluntarily provided by a you.
Collectively these technologies enable us to better understand and segment our users' audiences on an aggregate basis. Cookies do not allow us to gather any personal information about you and we do not store any personal information that you provided to us in your Cookies.
2. How We Use The Information
We may collect and use PII and Non-PII for purposes of administering and expanding our Site and/or Services, providing customer service, making available other sites and services to our users and prospective users, and enabling advertisers to deliver general and/or relevant ad content.
Occasionally, we may also use the information we collect to notify you about important changes to the Site, new Services and special opportunities we think you will find valuable. You may notify us at any time if you do not wish to receive these offers by emailing us at info@yooguide.com
Any personal information or content that you voluntarily disclose and/or post in public sections at the Site and/or Services, if applicable, may become available to the public at your own risk and sole discretion. If you remove such content, copies may remain viewable in cached and archived pages or if other users have copied or stored it.
By providing YooGuide your Email address you consent to our use of the Email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your Email address to send you other messages, such as newsletters, changes to features of the Site and/or Services, or special offers. If you do not wish to receive such Email messages, you may opt out by sending a written request by email to info@yooguide.com. However please note that opting out may prevent you from receiving Email messages regarding updates, improvements, or offers.
We may use certain information about you without identifying you as an individual to third parties. We do this for purposes such as analyzing how the Site and/or Services are used, diagnostics and resolving of technical problems, maintaining security, and personalizing advertisements and promotions.
We may use Cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized advertising, content, and information; (c) monitor the effectiveness of our Site and/or Services; (d) monitor aggregate metrics such as total number of visitors and traffic; (e) diagnose or fix technology problems reported by our users or engineers that are associated with the IP addresses controlled by a specific web company or ISP; and (f) help you efficiently access your information after you sign in.
3. How We Share The Information
As indicated above, we do not collect PII except when provided voluntarily by you. We do not rent, sell or disseminate PII to third parties for promotional purposes without your consent. We will only share this voluntarily-provided PII:
• to enable third party service providers to assist or facilitate in the Services we provide;
• to comply with applicable laws and regulations or to respond to a subpoena, search warrant or other lawful request for information we receive, whether or not a response is required by applicable law;
• to enforce an agreement or to protect our rights; with any parent, affiliated or successor entity;
• in connection with any asset sale, transfer, divestiture or liquidation;
• in connection with strategic alliances, partnerships or other business arrangements to permit the offering of products or services; or
• as permitted under any agreement with you.
We may allow third-party ad servers or ad networks to serve advertisements, or may ourselves serve advertisements, through the Site and/or Services. These ad servers or ad networks use technology to send advertisements and links directly to the end user’s browser. They automatically receive the end user’s IP address when this happens. They may also use other technologies (such as Cookies or JavaScript) to measure the effectiveness of their advertisements and to personalize the advertising content. YooGuide does not provide any PII to these ad servers or ad networks. However, please note that if an advertiser asks YooGuide to show an advertisement to a certain type of Users or audience, and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. You should consult the respective privacy policies of third-party ad servers or ad networks. This Policy does not apply to, and we cannot control the activities of, third-party advertisers. Any solicitation of personal information through such advertisements is strictly between the advertiser and end user.
4. Choice and Right to Inspect Information
You may choose voluntarily whether or not to provide us with your PII. Notices provided at the Site and Services where we collect PII should help you to make this choice. If you choose to avoid provision of your PII as we request it, you can still visit and use parts of the Site and/or Services, but you may be unable to access and use certain options, offers and services that involve our interaction with you.
You may request access to all your voluntarily-provided PII that we collected online and maintain in our database by sending a written request to info@yooguide.com.
5. Information Security
We use appropriate measures to ensure the security of all information, including the use of passwords, firewalls, encryption and remote servers, and routinely evaluate our practices to identify security threats or opportunities for the improvement of our Site and Services. No transmission of information is guaranteed to be completely secure. Unauthorized entry or use, hardware or software failure, and other factors may compromise information security. You acknowledge and agree to assume this risk when communicating with us.
6. Children's Privacy
We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register to the Site and Services. If you are under 13, please do not send any information about yourself to us, including your Email address. No one under the age of 13 is allowed to provide any personal information to us, including (but not limited to) on the Site and Services. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us promptly at info@yooguide.com.
7. Changes to Our Privacy Policy
By using the Site you consent to our collection and use of your personal information as described in this Policy. If we make material changes to this Policy, we will notify you by placing a post regarding those changes on the Site or by an Email message, as per our sole discretion.
We reserve the right to modify this Policy at any time, so please review it frequently. Changes to this Policy are effective when they are posted on this page.
